This document constitutes a legally binding agreement between Anivicus Technology ("Anivicus", "Platform", "Company", "We", "Our") and the End-User ("User", "Client", "Legal Professional", "You"). By accessing, browsing, or utilizing any services provided by Anivicus, you expressly acknowledge and irrevocably agree to be bound by the exhaustive compliances, terms, and conditions articulated herein.
In rigorous compliance with the Advocates Act, 1961, and the rules framed thereunder by the Bar Council of India (specifically Rule 36 of Section IV, Chapter II, Part VI of the Bar Council of India Rules), practicing legal professionals are strictly prohibited from soliciting work or advertising their services directly or indirectly.
By navigating through this platform, the User hereby acknowledges, confirms, and declares the following under their own free will:
Anivicus unequivocally operates as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. Our platform merely provides a digital infrastructure, serving as a conduit to connect individuals seeking legal services with independent, verified legal professionals.
Any legal opinion, consultation, drafting, or representation provided by an advocate registered on this platform is the sole professional and intellectual responsibility of that specific advocate. Anivicus exercises no control over, and assumes no liability for, the accuracy, legality, or outcome of such independent professional advice.
We maintain uncompromising standards of data privacy in absolute compliance with the Digital Personal Data Protection Act, 2023, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
The mere act of browsing the Anivicus website, submitting a general query on the public 'Legal Forum', or utilizing free digital tools provided by the platform does not create, imply, or constitute an Attorney-Client relationship.
Activation of Privilege (Section 126, Indian Evidence Act, 1872): Attorney-Client privilege and strict legal confidentiality are activated exclusively when a User formally engages an independent advocate through our platform, executes a Vakalatnama or Letter of Authority (where applicable), and remits the requisite professional consultation fee. Prior to this formal engagement, information submitted is treated as confidential business data under our Privacy Policy, but lacks statutory legal privilege.
To the extent that Anivicus provides paid technological subscriptions, SaaS tools, or facilitation services, we operate in compliance with the Consumer Protection (E-Commerce) Rules, 2020.
To preserve the sanctity of the legal ecosystem and prevent fraudulent impersonation, Anivicus enforces rigorous Know Your Customer (KYC) protocols:
Maximum Liability: Under no circumstances shall Anivicus Technology, its directors, employees, or affiliates be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of the use of, or inability to use, this platform or the services of independent advocates empanelled herein. The platform's maximum aggregate liability shall not exceed the technological convenience fee paid by the User to Anivicus in the three (3) months preceding the dispute.
The brand name "Anivicus", its logo, platform source code, UI/UX architecture, proprietary algorithms, and original content are the exclusive intellectual property of Anivicus Technology. Any unauthorized reproduction, scraping, data mining, or reverse engineering will invite immediate and stringent civil and criminal prosecution under the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000.
Anivicus shall not be held liable for any failure or delay in the performance of its technological obligations if such failure arises out of causes beyond its reasonable control, including but not limited to Acts of God, server downtimes, cyber-attacks, government regulations, internet service provider failures, strikes, or natural disasters.
This compliance policy, the terms of use, and any dispute arising out of platform engagement shall be strictly governed by and construed in accordance with the substantive laws of the Republic of India.
